4. Стиль письма, нейтральный в отношении гендерных различий

В деловой переписке нередко приходится использовать местоимения, содержащие указание на принадлежность к тому или иному полу: he, she, him, her,his, hers, himself, herself. Это представляет определённое неудобство в тех случаях, когда речь идёт не о конкретном человеке, а о лице в общем значении, безотносительно пола, например,owner, employer, seller, plaintiff, defendant,claimant, offender, etc. Кто-то предпочитает при этом использовать местоименияhe, his, кто-то, наоборот, использует местоимениеshe, her, а кто-то пользуется в одном абзаце местоимениемhe, а в другом - местоимениемshe. Многие используют формуhe or sheили he/she. Более предпочтительным, всё же, представляется нейтральный стиль, для которого характерны следующие моменты.

1. Замена местоимений артиклями:

Administering justice, a judge decides a case and gives his judgment.

Administering justice, a judge decides a case and gives the judgment.

2. Употребление форм множественного числа существительных и соотносимых с ними местоимений they и their:

A solicitor can speak for his client in lower courts.

Solicitors can speak for their clients in lower courts.

3. Использование форм пассивного залога:

At the trial the plaintiff must present his evidence of the suffered loss.

At trial the evidence of suffered loss must be presented by the plaintiff.

4. Замена местоимений (сам, сама, самой, самому) словом personally:

This liability will arise even though the owner is guilty of no wrongful act himself.

This liability will arise even though the owner is not personally guilty of a wrongful act.

5. Употребление местоимений who и whose:

A business lawyer can provide expertise in final planning. He'll help the client to deal with banks and trusts.

A business lawyer, who can provide expertise in financial planning, will help the client to deal with banks and trusts.

6. Использование местоименных комплексов he or she, his or her:

Every lawyer has his or her unique way of doing business.

A franchisor grants the rights to use his or her trademark to a franchisee.

Единых, общепринятых правил пользования нейтральным стилем не существует. Есть и другие способы нейтрализации гендерных различий. Выбрать адекватный способ в каждом конкретном случае поможет регулярное чтение аутентичных материалов по избранной специальности.
