3. Services performed by ncsp.

3.1. NCSP within the port area and designated aquatorium carries out operations and provides services on a contractual basis with shipowners, cargo owners or forwarding agents, charterers and other customers, including:

• Loading and discharging (including stowage), separation, (lashing, unlashing of cargoes, dry cleaning of holds, tweendecks after discharging of vessels stay­ing in the port

• Forwarding services

• Warehousing operations

• Transshipment of cargo from hinterland transport to water transport and vice versa

• Loading/discharging of vessels at the anchorage

• Issuance of Bills of Lading, Cargo Manifests, preparation of other cargo and transport documents

• Servicing and transportation of passengers

• Berthing/unberthing.

To carry out the above mentioned operations NCSP uses specialized facilities, terminals, multipurpose berths together with covered warehouses, open storage areas, own specialized equipment and machinery.

Refrigerated cargoes, grain and raw sugar in bulk are discharged directly from vessels into wagons or trucks. Grain may also be discharged into silos (berth 22)

NCSP handles dangerous cargo according to IMO, MOPOG Regulations. How­ever, preliminary agreement of NCSP is to be obtained prior to shipment of dan­gerous goods.

Delivery of cargo into the port is carried out after confirmation of NCSP.

3.2. In general the relationship between NCSP and other mode of transport for their handling in respect of functions undertaken by NCSP under the present Terms and Conditions is based on and in accordance with contracts concluded between NCSP and transport operators or their authorized representatives.

NCSP performs loading, discharging, warehousing and storage of cargoes on a direct contract basis with cargo owners or their authorized representatives.

In special cases (on road operations, combined transportation, supply delivery, lighterage, etc.) NCSP works out, together with the parties (customers) concerned, special terms of cargo-handling and handling of transport vehicles stating such terms in a Supplement to the present Terms and Conditions.

3.3. Ncsp provides services at additional requests-

• Provision of berths for vessels' idle stay.

• Arrangement of work on deratization, gas freeing, desinfection, fumigation of vessels and cargoes as well as hotel accommodation for crew members.

• Fresh water supply.

• Provision of refuse disposal containers, toilet facilities at vessel's disposal.

• Power supply to vessels.

• Telephone installation on board a vessel and connecting it to the shore tele­phone network.

• Cargo processing (repairing of tare, packing, unpacking of cargo, etc.).

• Marking and re-marking of cargoes.

• Other work and services, stipulated by contract including cargo declaration at customs, calculation of dispatch and demurrage. All services provided by NCSP will be charged in accordance with current tariffs.

4. Warranty.

4.1. Each customer, who intends to use services of NCSP warrants that he is either an owner or an authorized agent of cargoes or any plant brought to NCSP's premises and further warrants that he accepts these Terms and Conditions not only for himself but also as duly authorized agent for and on behalf of every other person or legal body.

4.2. A customer warrants unless otherwise specified in writing to NCSP that any cargoes or vessel or plant which he delivers or directs to the port area:

a) are not dangerous or liable to become so in the form in which they are deliv­ered and/or in which they are to remain while on port area;

b) are not toxic or liable to give off any injurious gas, dust, liquid or radiation;

c) will not contaminate or cause danger, injury or damage to any person or any other goods or plant or the port area;

d) are properly and sufficiently packed in accordance with the Rules in force;

e) are properly marked with any warnings as to the hazardous nature of any con­tent and with appropriate signs if there are special requirements for cargo handling ;

f) contain no unauthorized controlled drugs, contraband, pornographic or other illegal matters.
