Offers.

Offers made in writing usually state the nature and description of the goods offered, the quantity, the price, the terms of payment and the time and place of delivery. Offers may be firm (or binding) or without engagement.

A firm offer is made by the Seller to one potential Buyer only and usually indicates the time during which it will remain open for acceptance. If the Buyer accepts the offer in full within the stipulated time, the goods are considered to have been sold to him at the price and on the terms stated in the offer.

According to English and American law, a person making a firm offer has the right to revoke it at any time before it has been accepted. According to Russian law, a person making an offer is bound by it until the expiration of the time stated in the offer. When no time for acceptance is stipulated in the offer, the acceptance must be made within a reasonable time.

An offer without engagement does not bind the Seller and therefore may be made to several potential Buyers. If the Buyer accepts such an offer, the goods are considered to have been sold to him only when the Seller, after receipt of the Buyer’s acceptance, confirms having sold him the goods at the price and on the terms indicated in the offer.

Complaints.

Mistakes may occur in day-to-day business, and these give cause for complaint. There might have been a misunderstanding about the goods to be supplied; perhaps the warehouse clerk made an error in addressing the parcels; sometimes a consignment is dispatched too late or delays are caused in transit; damage may have occurred during delivery; a manufacturing defect is discovered when a machine is used. The customer is understandably annoyed, yet this is no reason to write an angry letter of complaint. He will get better results if he takes the trouble to explain his complaint clearly, and to propose ways in which matters can be put right. His company may make mistakes too: firms often have to manage with insufficiently trained personnel or to contend with a staff shortage, so mistakes and accidents happen.

You work at Central Business Consultants, 16 Hyde Towers, Hong Kong. The people who rent the office next to you play very loud music all day and every day, even though the contract for the offices says “no radios”. It is impossible for you to work.

Write a full letter to them, making a strong complaint. Follow the plan:

-say what you are writing about (the noise from their office),

-say exactly what is wrong,

-refer to the contract,

-demand immediate action and give them a warning (you will contact the landlord).

Background Information:

As Assistant Athletic Director, you’re in charge of ticket sales for college basketball games. Your school’s men’s basketball team is expected to be good this year, and more people have applied for season tickets than the arena will hold. In order to let as many different people as possible attend the games, you’ve decided to divide home games into two groups. Students expected to graduate this year, full professors and alumni who have bought season tickets for the last five years will get full season tickets to all the home games.

All other students, faculty, and alumni will get half season tickets. People whose last names begin with the letters A through L will get tickets to the odd-numbered home games (games 1, 3, 5 and so forth).
