Классификация и заключение международного договора
The Law of Treaties
In the broadest sense, an international convention or treaty is any agreement governed by international law. The Vienna Convention on the Law of Treaties is the primary source for the law of treaties. To be a treaty within the scope of the Convention a document must 1) be between states; 2) be in writing; and 3) be governed by international law. Treaties may be classified by the following criteria: contracting states, geographic factors, possibility of accession, subject matter, form or method of conclusion. Both the party (the state or international organization) and its representative must have the proper capacity to negotiate and conclude an international agreement. A document entitled a “full powers” document names those individuals who may negotiate and conclude a treaty on behalf of the state. All parties to a treaty must perform their obligations under the treaty in good faith. Article 26 of the Vienna Convention expresses one of the most fundamental principles of public international law, pacta sunt servanda: Every treaty in force is binding upon the parties to it and must be performed by them in good faith. A treaty may be amended by agreement between the parties. “Amendments” alter a treaty with respect to all parties. “Modifications” are made by a limited number of parties.
The grounds for invalidating a treaty are error, fraudulent conduct, corruption, coercion, conflict with peremptory norms (jus cogens), and conflict with domestic law. Treaties may be terminated or suspended by agreement of the parties, if the treaty so provides, or if the goal of the treaty is realized.
The doctrine of fundamental change of circumstances (rebus sic stantibus) is invoked to terminate obligations under long-term treaties, but international courts and arbitrators rarely find the doctrine applicable. Rebus sic stantibus, under the Vienna Convention, applies only when all of the following requirements have been met: 1) the change must be of a fundamental character; 2) the change in circumstances must have been unforeseen by the parties; 3) the circumstances at the time of entering the agreement must have been an essential basis of the treaty; 4) the change in circumstances must radically alter the performance of obligations yet to be performed under the treaty.
Доктрина коренного изменения обстоятельств (rebus sic stantibus) привлекается для прекращения обязательств по долгосрочным договорам, но международные суды и судьи редко находят доктрину применимой. Rebus sic stantibus, согласно Венской конвенции, применяется лишь в случае совпадения всех следующих условий: 1) изменение обстоятельств должно носить коренной характер; 2) изменение обстоятельств должно было быть непредвиденным участниками; 3) обстоятельства на момент заключения договора должны были составлять существенное основание согласия участников на обязательность для них договора; 4) изменение обстоятельств должно коренным образом повлиять на исполнение обязательств, все еще подлежащих выполнению по договору
